By adjudication, dated April 2, 1953, the Orphans’ Court of Philadelphia County awarded one-third of the estate to the Board of Directors of City Trusts with the following direction:
“…to expend the Fund, principal, and income to and among such former members of the Fire Department as were disabled in the line of duty and are now receiving a pension. The Board of City Trusts shall accept from year to year the designation of the eligible individuals by the commissioner of Fire. The amount to be distributed until the Fund is exhausted shall be at the rate of 10% of the pension payable to each recipient annually. Final payment shall be made pro rata among those eligible to receive the funds in the year when the same shall be exhausted.”
